Duties and Responsibilities
1. Background of the Assignment
As the global guardian of the United Nations standards and norms in crime prevention and criminal justice the United Nations Office on Drugs and Crime (UNODC) is mandated to support Member States in upholding the rule of law, promoting crime prevention and effective, fair, humane and accountable criminal justice systems.
In line with UNODC’s mission and mandate, the UNODC Strategy 2021-2025, UNODC Strategic Vision for Africa 2030, UNODC Regional Programme for Eastern Africa (2016-2021), and in close cooperation with the Regional Section for Africa and the Middle East at UNODC headquarters, the Criminal Justice Programme of ROEA seeks to implement these objectives through support of major justice reforms processes undertaken by East African States.
In adherence with this mandate, and in line with the priorities of the UN Kenya Sustainable Development Cooperation Framework 2022-2026, the second phase of the Programme for Legal Empowerment and Aid Delivery in Kenya (PLEAD II) was designed to support the Republic of Kenya’s adherence to international norms and standards on crime prevention, criminal justice, anti-corruption and human rights. The design of PLEAD II is informed by Kenya’s justice sector reform agenda, current priorities of key criminal justice institutions and citizens’ expectations, as well as the achievements and lessons learned during phase one of PLEAD. The Programme is funded by the European Union and targets nineteen (19) counties in Kenya.
The ODPP is an independent Office established by Article 157 of the Constitution of Kenya, 2010. It is responsible for instituting and prosecuting criminal offences, including terrorism and other complex offences, advising investigative agencies on instituting criminal charges, directing and supervising criminal investigations, reviewing prosecutions to ensure that accused persons are prosecuted based on adequate evidence and face appropriate charges in the appropriate court and upholding, protecting and promoting human rights. The ODPP has presence in all the 47 Counties in Kenya, as well as, in all the sub-counties where court stations exist. The Office took over the prosecution function by replacing all Police Prosecutors with Prosecution Counsel answerable only to the DPP. The ODPP has further decentralized its functions to the Counties, and has established thematic departments, divisions and units.
With the technical and financial assistance of UNODC through PLEAD I, the ODPP developed a novel strategic blueprint – the Excellence Charter (2020-2023). The Charter is a roadmap that harmonizes the implementation and realization of the ODPP strategic focus, aimed at transforming the ODPP into a prosecution service which is more responsive to the needs of the citizens. The Charter adopts a three-pronged approach: Re-casting, Retooling and Relearning. It further outlines 6 Strategic Commitments to guide the change towards the achievement of its the desired goals: Independence and Integrity; Lifelong Learning; Reshaping Prosecutions; Leadership; Organizational Effectiveness; and Inter-Agency Networks.
Implementation of the Charter was guided by a budgeted roadmap which classified the initiatives for implementation as immediate, short-term, medium-term and long-term, and these were to be measured using and Monitoring and Evaluation Framework and Performance Management System.
With the lapse of the current Excellence Charter in 2023, there is need to review progress against the set targets / milestones as highlighted in the Workplan. This will assist in identifying gaps and arising needs within the ODPP – that will inform the development f the next phase of the Excellence Charter.
2. Purpose of the assignment
The purpose of this consultancy is two-fold:
1. To support the process of identification of the progress against the Excellence Charter Workplan – by identifying the achievements, in progress and those that are pending.
2. To provide technical support in the development of the next phase Excellence Charter (2024-2027).
3. Specific tasks to be performed by the consultant
The Consultant will work under the overall supervision of the UNODC Regional Representative for Eastern Africa and the direct supervision of the UNODC ROEA Head of Criminal Justice Programme, and in close technical cooperation with the Programme Officer and the Associate Programme Officers under the Criminal Justice Programme in ROEA. The Consultant will hence support in the identification of the progress against the Excellence Charter Workplan as well as provide technical support through the drafting of the next phase Excellence Charter (2024-2027).
The consultant will undertake the following tasks:
a) Development of an Inception Report
– Undertake a literature / desk review by undertaking analysis of the progress made so far in the fulfilment of the commitments identified in the Excellence Charter. This will include, but not limited to, review of the strategies, policies, manuals and other documentation developed, digital and structural infrastructural developments, and all other interventions undertaken vis-à-vis the objectives set out in the Implementation Matrix and Roadmap;
– Identify the on-going and unaccomplished initiatives in the Implementation Matrix and Roadmap, and establish reasons for their delay and/or lack of achievement;
– Undertake a review of the M&E Framework and Performance Management System to inform the extent to which the Excellence Charter initiatives are being monitored, evaluated and measured;
– Undertake extensive consultations with the ODPP at the various levels – including headquarters, regional and county levels; departments and divisions, to determine extent of implementation of the Excellence Charter. Key stakeholders;
– Based on the above, develop an Inception Report which shall include findings from the desk reviews, findings of interviews with key staff members and stakeholders. The scope of the report will include, but not limited to, organizational culture, leadership model, capacity building, organisational effectiveness and change management, prosecutorial model and practices, human resources, public financial management, procurement practices and inter-institutional linkages, and research on international best practices.
b) Development of a final, comprehensive and validated Excellence Charter for the ODPP for the period 2024-2027, with a clear Implementation Matrix and Roadmap
– Support the development of the ODPP Excellence Charter (2024-2027) which shall include:
• Identified key Strategic Objectives which shall provide an overarching vision and set goals for the ODPP’s in the fulfilment of their desired outcomes;
• Development of an Implementation Matrix and Roadmap Report which puts forward department-specific short-term, mid-term and long-term recommendations;
• Facilitate extensive consultative workshops with internal and external stakeholders to inform the development of the Excellence Charter, and specifically the Implementation Matrix and Roadmap Report;
• Facilitate a one-day internal validation workshop of the Implementation Matrix and Roadmap to ODPP representatives, including regional representatives;
• Incorporate the feedback from the validation process;
• Submit a final and comprehensive Excellence Charter for the ODPP for the period 2024-2027, with a clear Implementation Matrix and Roadmap.
c) Reporting and other requirements:
The consultant will:
– Submit a final, comprehensive and output oriented report, submitted not later than three working days prior to the end of the consultancy;
Qualifications/special skills
An advanced university (Master or equivalent) degree in law, criminal justice, law, legal studies or a related field is required. A first-level university degree in similar fields in combination with two additional years of qualifying work experience may be accepted in lieu of the advanced degree.
– At least twenty (20) years’ experience working with governmental and/or international organizations in the development of strategic blueprints for organisations within the criminal justice sector is required.
– At least ten (10) years’ experience in providing technical assistance on organizational change and transformative leadership in the criminal justice sector is required.
– Experience working in a commonwealth jurisdiction is desirable.
– Experience in working with senior government officials in sensitive areas is desirable
Languages
English and French are the working languages of the United Nations Secretariat. For this position, fluency in oral and written English is required. Knowledge of another United Nations Secretariat language is an advantage.
