Legal Adviser – Independent consultant (60%)
Role
For a long term assignment, we are looking for an independent professional, to work for ISO central Secretariat Legal Services team on a regular basis. The role has a particular focus on contract law & negotiations, data protection and trademark law, but also involves copyright law and policy, competition law and other related legal areas.
Key responsibilities
1. Commercial:
- Provide advice with the review, draft and negotiation of a range of contracts (such as but not limited to SaaS, Supply and Consultancy Agreements, MoUs, Partnerships, Grants, Licensing, SoWs, Donors’ Agreements etc.;
- Manage commercial and legal risks and provide appropriate mitigation measures.
2. Data Protection:
- Advise the business on data protection-related aspects and projects involving processing of personal data;
- Review relevant documentation and implement processes to ensure compliance with the EU GDPR and Swiss data protection law;
- Draft and review data processing agreements;
- Review data subjects’ requests; carry out due diligence on new suppliers;
- Audit, review and adapt data protection processes as needed;.
3. IP:
- Advise on copyright related issues, particularly in relation to the interpretation of the policy and enforcement;
- Manage ISO Central Secretariat trademark registrations and renewals (including with some administrative work), assist ISO members in their registration process and provide support on oppositions or infringement cases;
- Manage IP litigations, including external counsel;
- Manage, liaise with and oversee anti-piracy service provider, including preparation of data analysis re: trends and opportunities.
4. Governance:
- Assist in the preparation of governance documents related to the work/mandate of the Legal Services
5. Miscellaneous:
- Develop trainings and training materials for ISO Staff;
- Develop internal legal guidance, directives and processes for ISO Staff;
- Update the wiki and member portal of the Legal Services pages;
- Draft case studies on various matters of interest to members;
- Keep abreast of legislative changes that may affect areas of interest for ISO.
Report to: Head of Legal Services
Qualification and Experience
- 5 to 7 years of experience in, and knowledge of, contract law, data protection and IP law
- Degree in Law. Additional specialization/certificate in IP law and/or data protection would be a clear asset
- Excellent spoken and written English, including demonstrated drafting skills
- Good working knowledge of French would be an asset
- Legally registered as an independent in Switzerland
