PURPOSE

The consultancy project will conduct research on the migration status and broader human rights situation of nationals of one or more Pacific Island countries who have moved to New Zealand. The consultancy will review how many nationals of Pacific Island countries are in New Zealand with irregular migration status? How many of them have sought international protection? How many have been granted asylum and on which ground? How many applications have been rejected and on which ground? How many have been granted humanitarian or other forms of protection? How have climate change considerations been integrated in protection considerations?

How have such considerations evolved since the UN Human Rights Committee’s decision in the Ioane Teitiota v. New Zealand case? What type of regular migration pathways are available to nationals of low-lying Pacific Island states? How accessible and currently used are they?

The purpose of the project is to make an argument towards better protection of nationals of Pacific islands. The project will highlight the need for further laws, policy and practice to ensure the human rights of people impacted by the climate crisis are adequately protected and promoted; and help Amnesty International develop its policies impacting those likely to experience climate displacement, migration or mobility.

Consultancy start and end date: This is expected to be a six month consultancy, from October 2023 to April 2024 focused on a specific project

Rate: £350 per day

OBJECTIVES AND DELIVERABLES

We are seeking a consultant researcher to work with the Refugees and Migrants’ Rights Team, the Climate Justice Team, the East and Southeast Asia and Pacific Regional office and Amnesty International New Zealand to develop and conduct research on the migration status of Pacific Islanders displaced in the context of the climate crisis and currently living in New Zealand.

The consultant will be required to develop and conduct research and legal and policy analysis on the migration status of nationals of one or more Pacific Island countries in New Zealand. They will be required to undertake the following:

  • Analyse the New Zealand legal and policy framework on migration in the context of climate displacement.
  • Draft and prepare a publication (expected length around 30 pages) on the topic of the migration status and human rights situation of nationals of one
    or more Pacific Island countries in New Zealand.
  • Leading specifically on information gathering, fact-finding, analysis and assessment of relevant human rights concerns in New Zealand.

ESSENTIAL REQUIREMENTS

The consultant is expected to work from New Zealand or one of the countries in the region. In line with Amnesty International’s anti-racist commitments, particular consideration will be given to hiring people from a Pacific Island country.

  • Extensive professional experience of undertaking research on human rights in the Pacific region, with a focus on climate change and/or refugee and
    migrant rights.
  • Experience of interviewing and dealing in an appropriate manner with witnesses and survivors of human rights violations.
  • Established networks and connections with Pacific Islander communities in New Zealand.
  • Excellent written and spoken English and the ability to produce clear, persuasive, and concise research documents, policy positions and strategy papers.
