This position is based at our Luxembourg headquarters and requires regular office presence. The EIB, the European Union’s bank, is seeking to recruit for its Legal Directorate (JU) – Legal Corporate Department (CORP)Procurement and Administrative Law Division (PA) at its headquarters in Luxembourg, a (Senior) Lawyer qualified in Luxembourgish law*

This is a full time position at grade 5/6 for which the EIB offers a permanent contract.

Purpose

The purpose of the role is to provide legal support to the administration and other directorates for legal issues within the remit of the Division with a particular emphasis on Luxembourg law governed corporate topics (contract law, construction and real estate, intellectual property, litigation, etc.). The work involves activities of various complexity and non-standard nature (taking instructions from the Head of Division on highly sophisticated and complex legal matters).

Operating network

You will report to the Head of Division and cooperate with the other lawyers of the team. You will liaise with other colleagues from the Legal Directorate, including Directors and General Director, as well as other Directorates. The role may involve liaison with external legal counsel and local authorities.

Accountabilities

  • Participate in the negotiation, drafting and / or review of legal documentation relating to all larger contracts with the Bank, including for construction and real estate issues.
  • Participate in providing advice on specific legal issues relating to the Bank’s presence in Luxembourg.
  • Participate in providing advice on contractual rights and obligations and on how to manage risks associated to contracts subject to Luxembourg law entered for the Bank’s own account, including in the fields of construction and real estate.
  • Participate in providing advice on how to manage risks associated with dispute resolution and pre-litigation issues in the above-mentioned fields.
  • Cooperate actively with other services within the Bank, taking a proactive, solution-oriented approach.
  • Advise on “administrative” (in particular Luxembourg law governed) matters, for instance intellectual property issues.
  • Participate in providing advice on dispute resolution before Luxembourg Courts.
  • Participate in, and advise on, the negotiation and drafting of agreements, notably in connection with the EIB Institute’s action.
  • Conduct legal research and studies on issues of law arising in connection with the division’s tasks and competencies.
  • Keep up to date knowledge of legislation, regulations and jurisprudence pertaining to the tasks and competencies of the division.
  • Develop and maintain relationships within the Bank and represent EIB externally.

Qualifications

  • University degree (minimum an equivalent to a Bachelor) in law.
  • Admission to practice in Luxembourg (List I or List II) is required. Admission to practise in another member state of the European Union is an advantage.
  • Minimum of 5 years of relevant professional experience in any of the fields of Commercial law, Construction / Real Estate law, preferably in the Luxembourgish context. Litigation experience would be an advantage.
  • Experience in advising and drafting legal documentation in the abovementioned fields in French and English
  • Solid knowledge of civil law fundamentals.
  • Familiarity with standard IT tools and Bank working procedures.
  • Fluency in written and spoken English and French are required. Knowledge of other EU languages would be an advantage.
